COMMENTS BY THE PUBLIC ON RESOLUTIONS
Debbie Darling, 263 Brookside Terrace – I’m also a representative of 4DNT which is a not for profit organization that’s putting on the New Year’s Eve Ball Drop. This is in reference to #11 on the Agenda, it’s the $25.00 special events application fee. We’re having the New Year’s Eve Ball Drop mostly in North Tonawanda and the question came up at one of our meeting as to why we have pay the City of Tonawanda $25.00 to file this Special Events application or permit I should say, it’s not really happening in the City of Tonawanda so I just wanted to bring it to your attention that we feel as though paying $25.00 to have an event that’s really not happening in the City is kind of unfair.
Bill Kinmartin, 127 Grove – Number 10, did this go out for bid?
Council President Zeisz – Oh, is that the towing contract? That was actually handled internally by the Police Chief, it’s a professional service, I do know that there had been some correspondence with other towers, but beyond that, I can get the answer for you.
Bill Kinmartin – I was just curious if anybody else was interested in towing or just the one.
Council President Zeisz - Walters has been the tower, I think it’s 45 of the last 46 years. There was one year that he didn’t have the towing, but primarily they have facilities here in the community and like I said, I do know that we did receive some correspondence from another company but they were outside the community, they weren’t right here in the City.
MOTIONS AND RESOLUTIONS
302. By Councilmember Slisz seconded by Councilmember Boyle Resolved, that the bills be allowed as audited and the City Clerk be directed to draw warrants on the Treasurer for the various amounts.

303. By Council President Zeisz seconded by Councilmember Poole Be It Resolved, that Chapter 10 of the Code of the City of Tonawanda entitled “Animals”, Article 2. Dogs, Section 10-33. Fee for dog license is hereby amended as follows:
That Section 10-33 “Fee for dog license” which reads as follows:
“The fee to be paid to the city for a dog license shall be as established in section 30-91.” - shall be deleted; and that this section shall now read as follows:
Section 10-33 “Licensing of Dogs”
(a) All dogs within the City of Tonawanda four (4) months of age or older, unless otherwise exempted shall be licensed. The owner of each dog required to be licensed shall obtain, complete and return to the Tonawanda City Clerk a dog license application together with the license application fee, any applicable license surcharges and such additional fees as may be established by the City of Tonawanda in Section 30-91 of the City Code. Each license application shall be accompanied by proof that the dog has been vaccinated against rabies or a statement from a licensed veterinarian that such vaccination would endanger the dog’s life in which case vaccination shall not be required. Each license issued shall be valid for a period of one year and shall not be transferable.
(b) The fee to be paid to the City for a dog license shall be established in Section 30-91; and be it further
Resolved, that Chapter 30 of the Code of the City of Tonawanda entitled “Fees”, Article 4. Animals is hereby amended as follows:
That Section 30-91 “Dog license” which reads as follows:
(a) The annual fees referenced in section 10-33 are as follows:
(1) For each spayed or neutered dog: $10.00.
(2) For each unspayed or unneutered dog under six months of age: $15.00.
(3) For each unspayed or unneutered dog six months of age or older: $18.00. - shall be deleted; and that this section shall now read as follows:
Section 30-91 “Dog license”.
(a) The annual fees referenced in section 10-33 are as follows:
(1) For each spayed or neutered dog: $10.00.
(2) For each unspayed or unneutered dog: $20.00.
and be it further
Resolved, that all other sections of said ordinance shall remain unchanged and in full force and effect; and be it further Resolved, that the above amendment shall take effect upon publication in an official newspaper of the City of Tonawanda.

By Councilmember Poole seconded by Council President Zeisz Whereas, Gerspach Properties, L.L.C. has filed a Petition with the City Clerk on September 14, 2010 to amend the Zoning District Map regarding a certain parcel of land located at 443 Franklin Street; and Whereas, said Petition was submitted to the Common Council for its consideration; and Whereas, the present zoning classification of the subject parcel of land is C-M General Commercial Services District and the Petition requests a rezoning to classification R-2 General Residence District; and Whereas, the Common Council requested the Planning and Zoning Board to review the Petition and make a recommendation; and Whereas, the Board conducted a Public Hearing on November 9, 2010 regarding the same; and Whereas, the Board subsequently recommended that this Common Council approve said Petition; and Whereas, a SEQR has been completed and a determination was made that the proposed action will not result in any significant adverse environmental impacts; now, therefore be it Resolved, that the Petition to amend the Zoning District Map filed by Gerspach Properties, L.L.C. regarding premises at 443 Franklin Street is hereby approved and the subject parcel of land is hereby rezoned to classification R-2 General Residence District; and be it further Resolved, that the Zoning Map shall be amended accordingly; and be it further Resolved, that this rezoning/ordinance shall become effective upon publication in an official newspaper of the City of Tonawanda.

By Council President Zeisz seconded by Councilmember Boyle Whereas, it is now standard practice for municipalities to develop and have in place a Comprehensive Emergency Management Plan which provides the framework for performance of emergency functions during a major emergency or disaster; and Whereas, the City’s Disaster Preparedness Advisory Committee, which includes Richard Barnard, Disaster Preparedness Advisory Committee Director, Fire Chief Charles B. Stuart and Police Chief John Ivancic, Co-Coordinators of the Disaster Preparedness Advisory Committee, Robert Williams, Thomas Balk, Nick Lichenthal, Dennis Berndt, Thomas Smyers and Dick Goodman, volunteers and Assistant Directors, has prepared a Comprehensive Emergency Management Plan, now, therefore be it Resolved, that the Common Council hereby approves and adopts the proposed Comprehensive Emergency Management Plan which provides the framework for the performance of emergency functions during a major emergency or disaster; and be it further Resolved, that Mayor Ronald J. Pilozzi and the Common Council members are hereby authorized and directed to execute the Promulgation Statement Letter contained within the Plan and any and all other documents necessary to effectuate the Comprehensive Emergency Management Plan.

Councilmember Boyle – Is this, Joe was talking about at the last meeting, that it’s really only going to be a difference of a couple hundred bucks, right?

By Council President Zeisz seconded by Councilmember Boyle Resolved, that the Mayor of the City of Tonawanda has determined that the following list of City of Tonawanda non-union department heads, other management employees, full time, part time, temporary and seasonal positions shall be granted the salary compensation as identified below for the City of Tonawanda fiscal year 2011 and be it further Resolved, that the Common Council and City Treasurer confirms that funds are available in the City of Tonawanda 2011 fiscal year operating budget to support said salary compensation including any increases, and be it further Resolved the Common Council approves the below referenced wages and compensation and directs they become effective on January 1, 2011 and that said list of positions and their corresponding wages shall be incorporated in Section 2.01 of the City of Tonawanda Personnel Benefits and Policy Manual.

By Councilmember Poole seconded by Council President Zeisz Whereas, the City of Tonawanda Police Department is in need of various towing services; and Whereas, Dan Walter & Son, Inc., a privately owned and licensed towing service located in the City of Tonawanda, has provided towing services to the City for several years pursuant to previous Contracts; and Whereas, the City desires to enter into a new Contract with Dan Walter & Son, Inc. to continue towing services, now, therefore be it Resolved, that Mayor Ronald J. Pilozzi is hereby authorized and directed to execute a contract between the City of Tonawanda and Dan Walter & Son, Inc., regarding towing services. A copy of the Agreement is on file in the Office of the City Clerk.

By Councilmember Boyle seconded by Council President Zeisz Whereas, a $25.00 Special Events application fee and application were received by the City Clerk for New Year’s Eve on the Canal at Gateway Harbor, and Whereas, the application is being reviewed and commented on by all appropriate department heads to insure the safety and well being of our residents, now, therefore be it Resolved, that permission be granted to the New Year’s Eve on the Canal at Gateway Harbor to close the Renaissance Bridge for a fireworks display on New Year’s Eve and be it further Resolved, that a Certificate of Insurance naming the City as additional insured be filed with the City Clerk no later than December 29, 2010.
Councilmember Poole – Mrs. Darling I think brought up a very good point about the fact that although we do close the bridge, the City doesn’t really have any other involvement in this and I personally would like to see the fee waived and the resolution go on without the fee.
Councilmember Slisz – I’ll second that.
Councilmember Boyle – We discussed that before when the Swiftwater wanted down there, and I think what it is, is it’s gonna be a picking and choosing on that. I don’t think it’s right but I mean, back when they wanted to close it down for the Winterwalk, they still had to put through for the $25.00 fee. We discussed it in there before that it’s a pick and a choose then, I mean, it’s $25.00, sure it does help the City, but then again though it goes back to the Swiftwater, that we should have waived the fee for what was going on for the Swiftwater.
Council President Zeisz – So you’re making a motion to waive the fee?
Councilmember Poole – Yes.
Council President Zeisz – Well the only thing we can do is, I’m assuming Mr. Boyle that you’re not willing to change the resolution?
Councilmember Boyle – It goes back to what we said before. We’re gonna be picking and choosing then. We talked about it in there.
Councilmember Poole – We probably need to come up with some standards then…
Councilmember Boyle - …I mean the one thing that we did for the Swiftwater was, with the Police Chief’s help, we ended up taking that third police officer that was on duty, we ended up bringing him in, it was a paper trail, they had to be brought in, off duty went up and helped with the Fall Fest up there. That was the one thing that we did do with to help them out.
Councilmember Poole - And I am concerned, I want this to be a joint effort between the two Cities. It obviously is with members of both Cities being very active in it.
Council President Zeisz – Actually we have very little participation in this Mr. Poole. In fact, we’re not even really consulted on the event but it does close down a bridge that half is in the City and half is in North Tonawanda and it can have an affect on our City due to the Pub Crawl.
Councilmember Poole - And it’s true the City Officials are not involved, citizens of the City.
Council President Zeisz - No, but the Common Council’s not. The Mayor, I should have clarified, the Mayor is but the Common Council isn’t.
Councilmember Boyle – I mean what I would do, Mr. President, is if we’re gonna waive the fee on this, then we have to go back and waive the fee for the Swiftwater…
Council President Zeisz - …I’m not waiving the fee, so I guess we’re at a standstill because I think that any event that affects the community, and it does affect us, granted the degree is smaller, but it does affect our community, should have to pay the fee.
Councilmember Poole - Mr. President, I guess in terms of that, I would be willing to withdraw my amendment.
Council President Zeisz – I mean it’s certainly something we can look at for next year because we are looking at some other issues with the Special Events, but I do think at this time, we should leave this in tact, and I’m willing to look at it for all of the events for next year, how we handle this, but I think we should leave this one in tact. So let’s put it to a vote.

COMMENTS FROM THE PUBLIC AFTER RESOLUTIONS
Nancy Paschen, 5 Main Street – I would like to thank Mr. Poole for mentioning in Caucus about the small entrances that they make on the sidewalks to get to the different places on Main Street. They should be a lot larger for the wheelchairs and stuff. And also, I’d like to say that they clean up the snow last night.
Debbie Darling – I’d like to thank all the Councilmembers that voted in favor of moving forward with the gazebo. I think it’s a great new jewel that we will have on the waterfront and I just would like to publicly thank those that voted for it. I think it’s going to be a really new asset for us to promote our City, so thanks.
Council President Zeisz – You meant the Pavilion, right?
Debbie Darling – Oh, right, yes, sorry.
Council President Zeisz – The gazebo, we’re moving ahead with that too.
COMMENTS FROM THE COUNCILMEMBERS AFTER RESOLUTIONS
Councilmember Boyle – This past Saturday, everybody that’s sitting up here with the exception of Ms. Bodie, we ended up going to the auxiliary and underwater squad party. It was a good showing. If anybody goes and they see at the Canal Fest, they see the Auxiliaries, the Underwater Squads, they had that tragedy over here on the Canal. It is a thankless job and it was nice to honor some people with awards and a one-year pin and stuff like that. It was very nice, well attended. Also I want to wish everyone a Happy Holiday and a very safe New Year.
Councilmember Poole – Congratulations to the winners of the house decorating contest. Thank you so much for working to make our community look so good. Thanks again to Legislator Hardwick for his presentation of the proclamation about our beloved gazebo and his generous donation of funding for the three hand-held radios for the auxiliary fire and police. I note that the boy scouts are here and I would like to thank them very much for coming. I wish everyone a blessed Christmas and condolences to the Proefrock and Phillips families in the recent loss of their family patriarchs. Thank you.
Councilmember Slisz – On December 26th, through January the 5th we are fortunate enough to have the World Hockey Tournament at the HSBC Arena. Now that is going to generate about 50,000 people, many from Canada, where all of them are hockey nuts, ten teams coming out of Europe, I can’t name them all, some are practicing in Jamestown some are practicing in Southern Ontario, that is going to take place at the HSBC downtown. The HSBC is located near the Naval Park and I have been on the Naval Park Board of Directors for some 25 years and if you haven’t seen the Naval Park recently there are a lot of improvements. They will be featuring $2.00 admissions to come into our museum. We will be having fast food for the hockey players and their friends. You can view the museum, you can view the ships and for $2.00 I think that is awfully cheap. Not only that, the Naval Park is one of the largest inland parks in the nation and I would say to you if you can’t see it this time certainly visit that during the Spring when we are open for business on April 1st. It is something to see and something to support so if you have the chance, please attend and I did want to wish everyone a Merry Christmas and Happy New Year.
Mayor Pilozzi – Thank you Council President Zeisz. First and foremost I would like to thank Chief Ivancic for taking the towing contract and taking some of the ideas he had and making it a lot more meaningful and it covers a lot of territory that was not covered before. He did a fine job with that. I think he should be recognized. What Councilman Slisz just mentioned is absolutely true that Naval Park is a gem in the rough and if you can go there please do that. They have done an excellent excellent job there and for $2.00 you can’t beat it. County Legislator Kevin Hardwick many thanks to you for your efforts here tonight and your proclamation. Proclamations are always nice but money is even better. It was very nice on your part, we thank you for that. Congratulations to all of the awardees tonight. I have known Joe Macielag and Charlie Bainbridge for a number of years now and they are both great guys and it was nice to see them here getting an award. Last but not least I would like to wish everybody a very Merry Christmas and a healthy and safe New Years. I will never forget, as Council President Zeisz mentioned in his opening prayer and statement, we have many young men and women overseas in harms way, keep them in your thoughts and prayers and hopefully some day there will be peace in this world, again, Merry Christmas and Happy New Year and thank you.
Council President Zeisz – I just had a couple of things. I just wanted to thank our County Legislator, we ask for money but we know you don’t have enough to give to us and he was right, we served together for six years and it was great, really great. I would like to thank Ms. Gregg and the rest of the Visual and Performing Arts Board, I thought it was great to have something like this where people are recognized for sprucing up the neighborhood at Christmas time and I thought it was great and I am sure there will be a lot more contestants next year. I want to thank the Boy Scouts, it is always go to see them come out. I am sure it is part of their civic duty but it is still great to have you here and give you an opportunity to see some of the things that go on in government and as far as everyone else, Merry Christmas and Happy New Year. We will see you next year. Drive home safely. We are also going to adjourn from the floor. Mrs. Bodie.
